Whether you were at the INTA Annual meeting last week or you’re sad and jealous like I am, here’s a recap of some best-ofs from the conference. Special shout-out to our friends at Brand Action!

What Just Patent?

Help your trademark clients avoid infringing someone else’s IP when they bring new products to market by securing a Freedom to Operate Opinion.

The Supreme Court has opted not to hear two patent eligibility appeals.

The USPTO is changing the requirements for practicing patent law, including separating out design patents from other types.

Security is important for patents, so the USPTO is looking to beef up its databases’ security.

ARTiculation

Last week, the Supreme Court ruled that Andy Warhol infringed Lynn Goldsmith’s copyright when he created his Prince Series.

What is the decision likely to mean for fair use going forward?

There has been a ton of criticism about the ruling, including from Justice Elena Kagan, who wrote in her dissent that the decision would do everything from “stifle creativity of every sort” to “impede new art and music and literature” to “make our world poorer.” Above the Law went so far as to call Kagan’s dissent a “diss track.”

However, Institute for Intellectual Property and Social Justice Director Lateef Mtima says the ruling promotes the idea that all artists’ works are valuable and worthy of protection.

If you’re sick of hearing about Warhol and Goldsmith, just know that neither is “the most faked artist in the world.” Want to take a guess who is?
